These terms govern the use of the probaro.io website. They are not a service contract: access to the Probaro product is covered by a separate agreement signed between Markaitek and the client.
1. Site publisher
This site is published by Markaitek, a company established in Quebec, 134 rue de l'Hermitage, Magog, Quebec J1X 0M7, Canada. Contact: info@markaitek.com.
Hosting is provided by OVHcloud, at Beauharnois, Quebec.
2. Purpose and scope
This site presents the Probaro product and lets you request a call. By using it, you accept these terms. If you do not accept them, do not use the site.
The site addresses people acting in a professional capacity.
3. What this site is not
- It is not a contractual offer. Feature descriptions, prices and timelines shown are indicative and may change without notice. Only a signed agreement binds Markaitek.
- It is not legal advice. References to Law 25 or to any other legal obligation are general markers. They do not replace analysis by a legal advisor who knows your situation.
- It is not a guarantee of compliance. No product feature on its own makes an organization compliant with any law. Compliance depends on how you use it.
4. Acceptable use
You undertake not to:
- attempt unauthorized access to our systems or those of our providers;
- disrupt the operation of the site, in particular through excessive automated load;
- systematically extract site content for commercial purposes;
- submit through the form personal information about third parties without the right to do so, or sensitive information we do not need;
- use the site for any unlawful purpose.
5. Intellectual property
The content of this site — text, layout, illustrations, code — belongs to Markaitek or is used with permission. You may consult and print pages for your internal use. Reproduction for any other purpose requires our written agreement.
"Probaro" and the Probaro symbol are trademarks of Markaitek. They are not registered at this date.
6. Form and personal information
Information you send through the form is handled in accordance with our privacy policy, which forms part of these terms. You confirm that the information provided is accurate and that you have the right to communicate it.
7. Site availability
We work to keep the site available, without guaranteeing uninterrupted access. We may change, suspend or withdraw part of it at any time, in particular for maintenance.
8. Limitation of liability
The site is provided "as is". To the extent permitted by law, Markaitek cannot be held liable for indirect, incidental or consequential damages arising from use of the site or from any inability to access it.
Nothing here limits liability that cannot lawfully be limited, in particular in cases of gross or intentional fault, nor any rights granted by the Consumer Protection Act where applicable.
9. Links to external sites
This site links to markaitek.com and to public bodies. We do not control those sites and take no responsibility for their content.
10. Changes
We may amend these terms. The update date at the top of the page is adjusted accordingly. The version in force is the one published on this page at the time you consult it.
11. Governing law
These terms are governed by the laws applicable in Quebec. Any dispute falls within the exclusive jurisdiction of the courts of Quebec.
12. Language
The French version of these terms governs. The English translation is provided for information only.
